Will the H-4 EAD be rescinded under the Trump administration?
In January 2018, the Department of Homeland Security (DHS) decided that the proposed H-4 EAD rule required revisions, which would require several weeks. DHS intends to publish a new rule by June 2018.
Even once the new rule is published, it will be required to go through the entire regulatory process. The public must be allowed to comment on the proposal, the comments must be reviewed, and only after all of this can a final rule be published.
Even if and when a final rule is published, it usually will not take effect for at least 60 days and is very likely to face litigation.
As of now, there is no immediate affect on H-4 EAD holders.
